Following a seven-day trial in the Commercial Division of the Supreme Court, New York County, Kurzman Eisenberg partners Bruce W. Bieber, John C. Re, and Jeffrey S. Peters secured a decisive victory on behalf of their client, a pharmaceutical distributor, in a high-stakes contractual dispute.
The case centered on two key issues: whether the defendants’ signatures on personal guarantees were authentic, and whether earlier guarantees and a related security agreement remained in effect or had been terminated.
After the presentation of all evidence and closing arguments, the jury returned a unanimous verdict in favor of the plaintiff. As a result, the defendants are jointly and severally liable for nearly $6 million, in addition to expenses and attorneys’ fees.
The verdict demonstrates Kurzman Eisenberg’s capability in trying complex commercial disputes from inception to conclusion in New York’s Commercial Division.
