Publications
The legal publisher, Matthew Bender, is publishing a new series of books on the litigation of real estate title issues, in which it shall be including portions of Mr. Koster's victorious pleadings, motion papers and appellate brief (co-authored by our colleague Judith Zerden, Esq.) to the Appellate Division of the Supreme Court, Second Department on behalf of our client, Bank of America, N.A., in the matter of Bank of America, N.A. v. 414 Midland Avenue Associates, LLC, et al., reported at 73 A.D.3d 746 (2nd Dept. 2010). The unanimous appellate decision has now become the leading case in New York governing the issue of wrongful real estate conveyances by co-tenants, and has been cited as controlling precedent by legal treatises on the subject. This is the second time Mr. Koster has been so-recognized and the quality of his advocacy so-honored. The Lawyer's Cooperative Publishing Company included portions of Mr. Koster's pleadings and briefs in its published volumes on estate litigation resulting from his successful trial and appellate litigation in Matter of Estate of Bello, which was reported at 227 A.D.2d 553 (2nd Dept. 1996).
